Liberata has an excellent and detailed understanding of the requirements of the Acquired Rights Directive, having successfully transferred over 4,000 employees under the TUPE regulations, over more than 30 occasions.

This has enabled us to develop tried and tested methodologies for integrating new employees seamlessly into the company. We have a well-established, unrivalled and proven track record and work to ensure that the transfer is a welcoming and motivating experience for our new employees. We achieve this by using a successful integration and induction model that is tailored to suit the individual requirements of all new contracts.

Employee Engagement Prior to Transfer

Liberata is conscious that change of any type is accompanied by anxiety. It is therefore essential that staff are involved as early as possible in the process and communications are clear and effective. Our engagement procedure is specifically designed to remove uncertainty, de-mystify the process and embrace all the employees as new and valued Liberata employees.

Consultation Process

Every TUPE transfer requires full employee consultation. For Liberata, one of the key requirements is to establish a clear communication and consultation process that lasts through the integration period and beyond. At pre-contract stage we welcome early discussion with any unions and/or elected employee representatives. This gives us the opportunity to reassure those transferring on any TUPE issues, and to discuss with them our service development plans and the impact they will have.

Presentations to Employees

The presentations welcome transferring employees into Liberata and provide information about the company’s history, its markets and culture. This reassures employees that we will honour our obligations under TUPE and answers any queries they may have. It also explains our plans for the service and how it can support employees in achieving their full potential. Finally, it indicates what we expect from transferring employees in terms of willingness to change, flexibility and commitment. 

Where TUPE legislation applies, Liberata honours all obligations, including protecting terms and conditions of service.
